Perspective

Essential to every case from the beginning to the conclusion is a proper perspective of the problem for which a remedy is sought, the resources available to be applied, the various alternatives for an efficient solution, and predictable optimum results. A primary role of the attorney is to be able to analyze the present condition of the client's rights and interests, keep the client informed as to the status, development and progress of the client's case, and predict with some degree of accuracy what the client may expect as the results of taking a particular course of action. The ability to maintain a proper perspective in providing legal services comes from experience, knowledge, and the exercise of candid judgment.

 

Preparation

Without thorough preparation, even a case with outstanding facts and brilliant lawyers will not be successful. Each case must be treated individually and distinctly. The preparation of no two cases is the same. The facts must be prepared by a thorough investigation of the events leading up to the incident which is the basis of the claim; interviews with all persons having knowledge of relevant facts; a thorough research of the law on substantive issues, discovery process, procedure, and evidence; search of the literature and databases to locate similar cases; networking among local attorneys and other lawyers across the country who have handled similar cases and/or similar issues; and maintaining an awareness as to public opinion concerning the type of case involved. Truly "no stone is left unturned" in the proper preparation of the facts and law in a successful case.

 

Persistence

The importance of persistence was stated by Calvin Coolidge:
